A.- TERMS OF USE OF www.GIGPOSSIBLE.com 1. Introduction The website and application www.GIGPOSSIBLE.com (the “Platform”) are owned and operated by GIGPOSSIBLE, a private company based in Rhodes, Greece (the “Company” or “GIGPOSSIBLE”). These Terms of Use govern access to and use of the Platform. By using the Platform, each visitor/user (“User”) confirms that they have read, understood, and unconditionally accepted these Terms. If you do not agree, you should not use the Platform. Use of the services is also subject to our Privacy Policy and Cookies Policy, which form an integral part of these Terms. The Company reserves the right to amend or update these Terms at any time. Any changes will take effect upon publication on the Platform. Continued use after such publication constitutes acceptance of the revised Terms. 2. Purpose of the Platform The Platform is an online intermediation service that connects: 1. Businesses/Organizations (hotels, restaurants, cafés, event venues, retail shops, etc.) seeking temporary or urgent staffing solutions; and 2. Workers/Professionals available to provide services on a shift or short-term basis. GIGPOSSIBLE provides only the technological means of connection. It is not a party to, nor does it participate in, any employment, contractual, or payment relationship between Users. 3. Definitions - Business/Organization: any natural or legal person registering on the Platform to post staffing needs or shifts. - Worker/Professional: any natural person registering on the Platform to provide services to Businesses. - Services of the Platform: digital tools that allow Users to create profiles, post or search for shifts, apply, accept offers, exchange messages, and review one another. - Agreement: any contract or arrangement concluded directly between a Business and a Worker outside the Platform. 4. Eligibility and Registration 4.1. Eligibility - Users must be at least 17 years of age to register. - Employment of minors is subject to Greek law, and Businesses bear sole responsibility for ensuring compliance. 4.2. Registration Obligations - Workers must provide accurate personal information (name, contact details, qualifications, experience, photo/profile, and, where applicable, tax details). - Businesses must provide valid company details (name, registered seat, Tax Identification Number, bank details for invoicing). - Each User is responsible for maintaining the confidentiality of their login credentials and for all activities conducted under their account. 5. Use of the Platform The Platform enables:  For Workers: registration, profile creation, browsing and applying for shifts, accepting assignments, performing services, and reviewing Businesses.  For Businesses: registration, posting of job needs/shifts, selecting Workers, supervising services performed, and leaving reviews. Notifications may be sent via email, SMS, or in-app alerts regarding applications, acceptances, and reviews. 6. Agreements and Payments - All payments are made directly between Workers and Businesses. - GIGPOSSIBLE has no involvement in contractual negotiations, wage determination, invoicing, or payments; however, the parties shall be required to notify the Platform of any agreements concluded as a result of their interaction. Failure to provide such notification may result in the suspension or termination of the User’s account and access to the Platform - Each party is solely responsible for compliance with tax, insurance, and labor law obligations. - GIGPOSSIBLE does not issue receipts or invoices on behalf of Users. 7. Reviews and Content 7.1. Reviews After an interview, shift, or cooperation, both Workers and Businesses may leave reviews (ratings and comments). Reviews may be submitted under the User’s name or anonymously where available. 7.2. Content Standards Reviews or content must not be offensive, defamatory, discriminatory, misleading, or otherwise unlawful. 7.3. Moderation The Company may, at its discretion, remove reviews, suspend accounts, or take other measures where content violates these Terms or applicable law. 8. Permitted and Prohibited Use Users must use the Platform lawfully and in good faith. In particular, Users may not: - post false, misleading, or fraudulent information; - impersonate another person or misrepresent qualifications; - use the Platform to harass, discriminate against, or exploit others; - upload harmful or illegal content (viruses, malware, offensive materials); - extract or copy Platform data through automated means (scraping). 9. Intellectual Property All content on the Platform (software, trademarks, logos, graphics, text, databases) belongs to GIGPOSSIBLE or its licensors and is protected under Greek, EU, and international intellectual property laws. No part of the Platform may be copied, modified, reproduced, distributed, or exploited without the Company’s prior written consent. 10. Limitation of Liability The Platform and its services are provided “as is” without warranties of any kind. GIGPOSSIBLE is not responsible for: - the accuracy, quality, or legality of information posted by Users; - the performance, quality, or payment of services between Users; - accidents, damages, injuries, or losses arising out of work performed; - delays, errors, interruptions, or unauthorized access to the Platform. To the fullest extent permitted by law, GIGPOSSIBLE disclaims all liability for any direct or indirect damages arising from the use of the Platform. 11. Termination and Suspension The Company may suspend or terminate a User’s account if these Terms are breached, if the User fails to notify the Platform of any agreements concluded through its use, if fraudulent or unlawful activity is suspected, or where required by law. Users may also deactivate or delete their accounts at any time. 12. Governing Law and Jurisdiction These Terms are governed exclusively by Greek law. Any dispute shall be subject to the exclusive jurisdiction of the courts of Athens, Greece. B.- PRIVACY POLICY 1. Introduction This Privacy Policy explains how GIGPOSSIBLE (“Company”, “we”, “us”) collects, uses, stores, and protects personal data of Users (“you”) when using the Platform www.GIGPOSSIBLE.com (the “Platform”). We are committed to protecting your privacy and processing personal data in compliance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and Greek Law 4624/2019 implementing the GDPR. By using the Platform, you acknowledge and agree to this Privacy Policy. 2. Data We Collect We may collect and process the following categories of data: - Identification Data: name, surname, date of birth, nationality, ID/passport details (where required by law). - Contact Data: phone number, email, address. - Professional Data: qualifications, CV, skills, work experience, references, spoken languages. - Business Data: company name, registered seat, Tax Identification Number (AFM), bank account details. - Profile Data: photo, bio, availability, reviews, ratings. - Transaction Data: contracts, invoices, receipts exchanged directly between Users. - Technical Data: IP address, browser type, device information, cookies. - Communications: messages exchanged via the Platform, support requests. 3. How We Use Personal Data Personal data is used strictly for the following purposes: 1. To enable registration and management of User accounts. 2. To facilitate posting and searching for shifts or services. 3. To allow communication between Workers and Businesses. 4. To enable reviews and feedback. 5. To ensure compliance with legal obligations (tax, labor, anti-fraud). 6. To maintain and improve Platform functionality and security. 7. To send notifications and service-related updates. We do not use your data for automated decision-making or profiling that produces legal effects without your consent. 4. Legal Basis of Processing Processing of personal data is based on: - Performance of a contract: to provide the Platform’s services. - Legal obligations: compliance with Greek and EU laws. - Legitimate interests: ensuring safe, efficient operation of the Platform. - Consent: for specific optional services (e.g. newsletters, marketing). 5. Sharing of Data We may share personal data only where necessary: - with other Users (e.g. once a shift is accepted, relevant contact details may be shared); - with service providers (e.g. IT, hosting, email, SMS) under confidentiality agreements; - with lawyers, accountants, or authorities where required by law; - with competent public authorities in case of disputes or inspections. Data is not transferred outside the EU/EEA unless adequate safeguards (e.g. Standard Contractual Clauses) are in place. 6. Data Retention - Account: for as long as your account remains active. - System/Security Logs: up to 6 months (or longer if required for the investigation of an incident). - Reviews/Compliance History: for reasons of transparency, security, and abuse prevention, such data may be retained for a reasonable period of up to 18 months after account deletion, subject to minimization or pseudonymization where feasible. - Legal/Accounting Obligations: in accordance with the statutory deadlines under Greek law. After the retention period has expired, data is either securely deleted or anonymized. 7. Data Security We apply appropriate technical and organizational measures to protect personal data against unauthorized access, loss, alteration, or disclosure. 8.
